「Link著數會員卡」服務之條款及細則(「本條款及細則」)

本條款及細則適用於任何進入及/或使用「Link著數會員卡」服務 ( 「服務/本服務」 )之客戶。 當客戶辦理/進入/使用本服務,即表示客戶已同意以下本條款及細則並受其約束: 1.本服務適用於以下客戶(「合資格客戶」): a)中國移動香港有限公司(「中國移動香港」)個人電訊服務計劃之客戶(不包括家居寬頻客戶、內地號碼註冊及非中國移動香港客戶)(「月費客戶」);及 b)除月費客戶外的持有MyLink賬戶之其他中國移動香港客戶或持有MyLink賬戶之非中國移動香港客戶(「MyLink其他客戶」)。 2.本服務分為以下計劃,詳情如下:

Link著數會員卡(單次訂購)(「單次會員卡」) 標準月費:HK$19 N/A -計劃僅適用於合資格客戶申請。 -計劃的服務費用以積分兌換及/或電子現金支付方式單次繳付,客戶可通過MyLink App-側邊欄-「我的訂單」-「服務訂單」中查看訂購記錄。 -單次會員卡的服務期限,詳見本條款及細則第4條。
3.「Link著數會員卡」服務12個月合約優惠與「Link著數會員卡」服務24個月合約優惠合稱「合約服務」。合約服務與「Link著數會員卡」(按月服務)合稱「增值服務」。 4.就本條款及細則而言,「服務期限」定義如下: a)就增值服務而言服務期限按帳單月計算。帳單月指申請增值服務之個人電訊服務計劃每個月的賬單發單日期計算至下個月發單日期的前一天。 b)就單次會員卡而言,服務期限為自訂購日期當日起計30個自然日內。 5.就本條款及細則而言,自然日指每日00:00/本服務生效時間(以較後者為準)起計至當日的23:59分。 6.合資格客戶可通過以下方式完成辦理並享用本服務: a)月費客戶可透過中國移動香港網上商店、12580熱線、門市或MyLink App-「權益」欄目-我的權益「Link著數會員卡」橫幅進入本服務辦理頁面成功辦理訂購增值服務; b)合資格客戶可透過MyLink App-「權益」欄目-我的權益「Link著數會員卡」橫幅進入本服務辦理頁面成功訂購單次會員卡。 7.每個電話號碼最多可以申請一個本服務。 8.成功申請本服務後,中國移動香港會向客戶發送確認短信。 9.當中國移動香港已向客戶收取服務費及 / 或客戶已支付費用,該等服務費不能退款或交換。 10.本服務具體服務內容如下: 辦理本服務後,客戶可享受商品會員價、日日拎著數、指定產品返積分三項權益(統稱「會員卡權益」),詳情如下: a)商品會員價 (i)客戶訂購本服務期間可於每個服務期限內透過本服務以指定折扣價格(「會員折扣價」)於MyLink 平台購買指定的電子券商品、實體商品及/或保險產品(「指定折扣價商品」)。 (ii)客戶知悉並同意本服務下可享的會員折扣價及會員折扣價權益適用的指定折扣價商品將不時更動,但會員折扣價將與指定折扣價商品之正價最少相差港幣1元(「最低折扣」)。 (iii)客戶可享的「會員折扣價」及「指定折扣價商品」以(1) MyLink App - 「權益」欄目-「Link著數會員卡」入口進入「我的會員」頁面(「會員卡頁面」) - 「會員價」欄目;及(2) 具體指定折扣價商品之MyLink商品詳情頁面上實時顯示的會員折扣價為準。 (iv)指定折扣價商品之正價以指定折扣價商品之MyLink商品詳情頁面顯示為準。 b)日日拎著數 (i)客戶訂購本服務的服務期限期間每個自然日內可於會員卡頁面的「日日拎著數」欄目點擊領取指定跨境巴士優惠券、指定商戶消費優惠券及/或中國內地消費優惠券(「每日優惠劵」)。 (ii)每日優惠劵或有領取的數量上限,優惠劵以及相關領取數量上限的詳情以相關優惠劵的說明頁面顯示為準。 (iii)每日優惠劵的使用受相關條款及細則約束,詳情請瀏覽每日優惠劵個別的說明頁面。 (iv)每日優惠劵均有使用有效期,具體有效期以相關優惠劵的說明頁面顯示為準。客戶須於有效期滿前使用每日優惠劵,逾期作廢,並將不獲補發或延長有效期。 (v)客戶通過本服務可領取的每日優惠劵須於開放領取的當日內領取,逾期將不獲補發及不設補領。客戶在每個自然日內可領取的每日優惠劵均不可累積或撥入至下一個自然日。 (vi)客戶知悉並同意本服務下可領取的每日優惠劵、每日優惠劵的種類及每日優惠劵適用的產品/服務將不時更動,但在客戶成功領取服務期限期間所有可領取的每日優惠劵的情況下,該服務期限期間內所有領取的每日優惠劵合共的面額價值將不少於港幣20元。 (vii)客戶可領取的每日優惠劵以會員卡頁面實時顯示為準。 c)指定產品返積分 (i)客戶訂購本服務的服務期限期間以電子現金支付的方式購買指定產品(「指定回贈產品」),可按照本條款及細則第10 c條獲得相應數量MyLink積分回贈。 (ii)指定回贈產品設有不同的MyLink積分回贈的百分比(「回贈百分比」),指定回贈產品的回贈百分比以指定回贈產品的詳情頁面所顯示為準。 (iii)客戶訂購指定回贈產品可獲的MyLink積分回贈計算公式如下:
扣除使用的優惠及MyLink積分抵扣的部分後客戶訂購指定回贈產品單筆訂單實際支付的港幣金額 × 回贈百分比 × 100 (MyLink積分兌換比率) = 可獲的MyLink積分數量 (如非整數,可獲的MyLink積分數量 將向下舍入至整數)
d)客戶每個服務期限最多可透過指定產品返積分權益領取合共1500積分的回贈。客戶於服務期限內所獲得的積分回贈達到1500積分的上限後,任何購買指定回贈產品所支付的金額均不會獲得任何積分回贈。 e)客戶知悉並同意本服務下指定回贈產品及相關的回贈百分比將不時更動,但服務期限內最少會提供2個回贈百分比不少於1%的指定回贈產品。 f)指定回贈產品及回贈百分比以會員卡頁面的「現金支付積分回贈」實時顯示為準。 g)所有積分均有使用有效期。積分有效期取決於積分被存入客戶的MyLink賬戶之時間。 h)客戶應於積分有效期滿前使用積分作兌換獎賞或購買指定產品/服務,逾期作廢,並將不獲補發或延長有效期,兌換MyLink積分須參閱並同意MyLink積分計劃的條款及細則(詳情載於https://www.hk.chinamobile.com/tc/mylinkpoints.html )。 11.就單次會員卡而言,除非客戶再次申請單次會員卡,否則服務期限到期後中國移動香港將自動終止向客戶提供本服務及本服務所包含之權益內容。 12.就合約服務而言,當客戶的合約服務之合約屆滿後,除非客戶通知中國移動香港終止合約服務,中國移動香港將自動按月提供本服務並按月收取當時本服務的最新價格/標準月費。 13.就「Link著數會員卡」(按月服務)而言,除非客戶通知中國移動香港終止本服務,否則中國移動香港將繼續按月提供「Link著數會員卡」(按月服務)並按當時最新的標準月費按月自動向客戶收取服務費用。 14.本服務適用之電子券商品、實體商品、保險產品之說明及條款,請以具體電子券商品、實體商品、保險產品之條款及細則為準;中國移動香港有權隨時修改此類產品特別說明而不作另行通知。 15.成功辦理本服務之客戶,如欲終止本服務,可通過以下形式中止: a)就增值服務而言,客戶須經MyLink -「我的增值服務」自行終止。亦可親臨門市或撥打客戶服務熱線 12580 通知中國移動香港,否則中國移動香港將繼續提供本服務並收取有關費用。 b)就單次會員卡而言,單次會員卡將在服務期限結束後自動終止服務。 16.中國移動香港並不會對有關商品會員價、日日拎著數、指定產品返積分三項權益適用的產品/服務(「權益產品」)之任何相關資料、內容及其功能,包括但不限於任何商業適售性、或特定目的之適用性、可用性、質量、性質、準確性和實用性、或當中可能包含之知識產權之正當性作出任何陳述、保證或承擔任何責任。 17.中國移動香港就所購買/換領的權益產品的描述所提供的資料、文字、相片、示意圖及圖片等均僅供參考,請以實物為準。 18.權益產品內容如有任何更改、或第三方供應商/公司停止供應產品、或第三方供應商/公司以任何其他第三方供應商/公司產品作為權益產品之替代,恕不另行通知。中國移動香港概不負上任何賠償責任。 19.中國移動香港對第三方供應商/公司提供的權益產品或服務之品質、安全性及合法性,刊登內容之真實性及準確性,第三方供應商/公司的商譽與可信性均無控制力及保證。客戶如對權益產品的質素或供應情況有任何查詢、申索或投訴,應直接向有關第三方供應商/公司提出。中國移動香港對此不承擔任何責任。 20.如任何客戶有任何違反法律、本條款及細則或可能損害第三方權利的行為或不作為,該客戶同意並契諾向中國移動香港為其行為或不作為引致或相關的任何糾紛及索賠作出全面彌償以及使中國移動香港免受損害。 21.本服務只供客戶本人個人使用,絕不能複製、轉售、與人分享、記錄或轉寄任何從本服務取得的內容或以其他人名義建立帳戶。 22.就增值服務而言,如客戶終止申請增值服務的中國移動香港流動服務月費計劃,本服務將會被取消。就單次會員卡而言,如客戶終止申請單次會員卡的MyLink帳戶,本服務將會被取消,即使其後重新以同樣的電話號碼註冊MyLink帳戶亦不會獲任何補發或補償。 23.中國移動香港可隨時在發出或不發出通知的情況下 (i) 取消或暫停本服務或其中任何部份;(ii) 限制或暫停客戶使用本服務,如中國移動香港認為基於客戶對本服務之使用,此等行動是適當的;(iii) 基於不同原因而使中國移動香港認為是對本服務之管理或運作或中國移動香港的業務是必要的而採取或不採取任何行動以致擴大、減少、修改、暫停、限制本服務或其中任何部份,或使其不能使用或受到不良影響。 24.中國移動香港對任何第三方供應商(「供應商」)所提供的商品或服務之品質、安全性及合法性,供應商的商譽與可信性均無控制力及保證。如對商品或服務的質素或供應情況有任何查詢、申索或投訴,客戶應直接向有關供應商提出。中國移動香港對此不承擔任何責任。 25.客戶獲取每日優惠劵、會員折扣價及/或積分後,不可退換或兌換現金,亦不能更換丶出售、分拆、轉贈或轉讓他人。 積分使用及注意事項 免責聲明 26.客戶同意不會使用本服務作出以下行為及 / 或用途: (a)      涉及或容許任何侵犯第三方供應商權利、版權或知識產權之行為或內容; (b)      涉及或容許任何違法、不當、淫穢、猥褻、不道德、誹謗、詐騙或不誠實使用、誤導、歧視、煽動仇恨、煽動叛亂、分裂、危害公共秩序或危害國家安全等行為或內容; (c)       涉及或容許駭客活動、攻擊、干擾或未經授權登入、使用或查閱其他任何第三方供應商裝置、設備、設施、系統、網站、網頁、資料或內容; (d)       接收、抄錄、發佈、分發或分銷、傳遞或傳閱、或任何利用非法或未經授權之內容; (e)       接收、抄錄、發佈、分發或分銷、傳遞或傳閱、或任何利用商業內容或作商業或傳銷用途;及 (f)       涉及或容許任何儲存、使用、上下載任何工具或軟件以作收集任何地址或 IP 位址、任何個人資料、或任何未經授權之資料。 27.中國移動香港不保證以下事項: (a)      本服務符合客戶的要求; (b)       本服務不受干擾、及時提供、安全可靠或免於出錯; (c)       由本服務之使用而取得之資料為正確或真實;或 (d)       客戶經由本服務取得之任何服務、資訊或其他資料將符合客戶的期望。 28.客戶明白、確認及同意本服務是由中國移動香港按「原樣」和「可用」的基礎提供的。中國移動香港不就本服務的提供(包括但不限於服務的任何目的的適用性、質量標準或性能或準確性)作出任何類型(明示或暗示)的陳述或保證。中國移動香港在此明確不保證服務不會中斷、沒有錯誤或沒有任何污染或破壞性的財產。 29.中國移動香港不會對任何客戶通訊或個人化設定之時效、刪除、傳遞錯誤、未予儲存資料或因任何資料之下載而導致客戶的流動通訊設備內資料遺失及無法恢復承擔任何責任。 30.客戶同意中國移動香港不會就客戶使用本服務的任何功能或內容及本服務可能或實質所造成或引致的任何後果、費用、支出、損失或損害負上任何責任。 31.在任何情況下,中國移動香港均不對本服務的任何收入損失(無論直接或間接)、利潤損失或任何間接損失承擔合同、侵權(包括疏忽或違反法定義務)或其他方面的責任。 32.中國移動香港在任何情況下均不對客戶就任何間接、附帶、後果性、依賴或特殊損害或收入損失、數據丟失、儲蓄損失或任何形式的利潤損失提出索賠,不論訴訟形式如何,無論是在合同、保證、嚴格責任或侵權行為,包括但不限於任何類型主動的還是被動的疏忽。 33.在無損上文之一般性及在法律容許的最大程度下,中國移動香港在本服務下承擔的全部責任金額,包括與本服務相關的索賠、費用、損害賠償等,均不得超過任何索賠事件發生前 12 個月內客戶所支付的服務費總額。 34.客戶利用數據網絡下載MyLink及/或使用本服務時,客戶須繳付數據傳輸費用,或從月費計劃/組合之數據用量中扣除。如客戶在香港境外下載MyLink及/或使用本服務,或需另行支付有關之漫遊數據費用 35.客戶不得以任何理由要求回贈或退款,包括但不限於本服務任何功能或內容於任何時間內由於維修或技術問題或於中國移動香港不能控制的情況下而被中斷或暫停服務,或客戶因不同原因而不能使用本服務或串流其中之內容。 36.中國移動香港可隨時在發出或不發出通知的情況下︰ (a)取消或暫停本服務或其中任何部份,以作出系統維修、更新、測試及 / 或維修; (b)  在中國移動香港認為客戶不適當地使用本服務的情況下限制或暫停客戶使用本服務;或 (c)中國移動香港基於不同原因認為本服務在無障礙條件下對本服務管理或運作或中國移動香港的業務產生不利影響。中國移動香港可採取任何行動以致擴大、減少、修改、暫停或限制本服務任何功能或內容。 37.中國移動香港發現客戶可疑或不確定、欺詐、欺騙、非法或不正當使用本服務下,中國移動香港可暫時或永久暫停客戶使用本服務。 38.凡由於中國移動香港無法合理控制或並非其過失或疏忽所致的原因,包括但不限於電力故障、戰爭、面臨戰爭威脅、騷亂或其他公民抗命行為、暴動、天災、由政府或任何其他國家法律機關所實施的限制或任何其他工業或行業糾紛、火災、爆炸、風暴、水災、雷電、地震及其他自然災害,以致延遲或未能履行本條款及細則的全部或部分條款而造成任何損失或損害,中國移動香港均無須負責。 個人資料收集聲明 39.客戶參與本服務即同意及接受中國移動香港收集、使用和披露其個人資料用於本服務之行政及與本服務一切相關用途,以及其他在一般個人資料收集聲明和私隱政策聲明中列出的用途。客戶已細閱、明白及同意中國移動香港之一般個人資料收集聲明及私隱政策聲明所載之內容,並同意接受其約束。上述聲明分別載於︰https://www.hk.chinamobile.com/tc/home/contract-terms-conditions/event-tnc-list#3-0及https://www.hk.chinamobile.com/tc/home/contract-terms-conditions/event-tnc-list#1-0。 40.上述聲明乃遵照《個人資料(私穩)條例》(香港法例第486章)的要求而發出,通知客戶收集資料的目的,及客戶同意中國移動香港使用這些資料及其權利。客戶有權根據《個人資料(私隱)條例》(香港法例第486章)的規定,要求查閱或更正客戶之個人資料。如有任何查閱或更正資料的要求,請參閱中國移動香港的私隱政策聲明之詳情。 41.客戶如欲查閱個人資料及更正個人資料須致函: 中國移動香港有限公司,地址:香港新界葵涌葵昌路51 號九龍貿易中心1 座 20 樓,收信人:資料保護主任;或致電中國移動香港拒收商業電子訊息登記熱綫6226 4926 或客戶服務熱綫12580。 其他注意事項 42.本條款及細則及一切與本條款及細則相關的事項均應受香港特別行政區法律專屬管轄及以其作解釋及執行。客戶同意,如有任何分歧、爭議、請求或索賠等,將不可撤回地及無條件地服從香港特別行政區法院的專屬管轄權。 43.本條款及細則中的每一條條款應有獨立的執行力,其有效性不受其他條款之無效性影響。 44.除客戶和中國移動香港外,任何人均不享有《合約(第三者權利)條例》(香港法例第623章)下的任何權利,以執行或享有本條款及細則任何條文的利益或權利。 45.中國移動香港保留隨時更改本服務內容及收費、終止本服務、及/或修訂本條款及細則的權利,恕不另行通知。任何有關服務的臨時改動或取消,將以中國移動香港的公佈為確據。 46.本服務不設上訴機制。如有任何爭議,中國移動香港保留最終決定權。任何爭議將以中國移動香港之系統記錄作為確據。 47.本條款及細則的中、英文版如有任何歧義,概以中文版為準。

Link Jetso VIP Service Terms and Conditions

These terms and conditions ("Terms") apply to any customer who accesses and/or uses the "Link Jetso VIP" service (the "Service" or "this Service"). By subscribing to/accessing/using the Service, the Customer is deemed to have agreed to and be bound by the following Terms.​ 1.Eligible Customers​ The Service is available to the following customers ("Eligible Customers"): a)Customers of China Mobile Hong Kong Company Limited ("CMHK") monthly billing plans (excluding those registered with Mainland numbers and non-CMHK customers) ("CMHK Monthly Customers"); b)In addition to monthly billing plans customers, other CMHK customers who hold MyLink accounts or non-CMHK customers who hold MyLink accounts. ("MyLink Other Customers").​ This service is divided into the following plans, and the details are as follows:

Link Jetso VIP 12-month-Service Contract Special Monthly Fee: HK$15/month (Standard Monthly Fee::HK$19/month) 12 billing months -The plan is only applicable to monthly fee customers for application. -The service monthly fee of the plan will be charged in advance on a monthly billing cycle. If a customer uses the service for less than one billing month, the full monthly fee will still be charged. The service fee will be automatically credited to the customer’s China Mobile Hong Kong account and shown on the bill (a "billing month" refers to the period calculated from the bill issuance date of the China Mobile Hong Kong individual mobile telecommunications service monthly plan used by CMHK monthly fee customers for this service to the day before the next bill issuance date). -For the definition of the plan’s service term, please refer to Clause 4 of these terms and conditions.

Link Jetso VIP (Single month) Standard Monthly Fee::HK$19 N/A -The plan is only applicable for application by eligible customers. -The service fee for the plan shall be paid in a one-time manner via points redemption and/or e-cash payment. Customers may view their subscription records in MyLink App - Sidebar - 'My Orders' - 'Service Orders'. -For the service term of the one-time membership card, please refer to Clause 4 of these terms and conditions.
3.The Link Jetso VIP 12-month service contract offer and Link Jetso VIP 24-month service contract are collectively referred to as "Contractual Services". Contractual Services and the Link Jetso VIP (monthly renew) are collectively referred to as "Value-Added Services". 4.For the purposes of these terms and conditions, the "Service Term" is defined as follows: a) In respect of Value-Added Services, the Service Term shall be calculated on a billing month basis. A "billing month" means the period calculated from the bill issuance date of the individual telecommunications service plan for which the Value-Added Service is applied to the day before the next bill issuance date. b) For the one-time membership card, the Service Term shall be 30 natural days from and including the subscription date. 5.For the purposes of these terms and conditions, a "natural day" shall mean the period commencing at 00:00 or the service activation time (whichever is later) and ending at 23:59 on the same day. 6.Eligible Customers may subscribe to and enjoy the Service through the following means: a)CMHK Monthly Customers may access the Service subscription page via CMHK's eShop, CMHK stores, or the MyLink App - under the "Vouchers" section - My Vouchers - the "Link Jetso VIP" banner, and successfully subscribe to the Service to enjoy it; b)MyLink Other Customers may access the Service subscription page via the MyLink App - under the "Vouchers" section - My Vouchers- the "Link Jetso VIP" banner, and successfully subscribe to the Service to enjoy it.​ 7.Subscription Limit​ Each mobile number may apply for at most one subscription to the Service. Multiple subscriptions will not result in overlapping service content.​ 8.After successfully applying for this Service, CMHK will send a confirmation SMS to the customer. 9.Once CMHK has charged the customer for the service fees and/or the customer has paid the fees, such service fees cannot be refunded or exchanged. 10.Service Content​ Upon subscribing to the Service, Customers may enjoy three benefits: Member Pricing, Daily Offers, and Designated Product Point Rewards, details as follows: a)Member Pricing: (i) During the subscription period of this Service, the Customer may, within each Service Term, purchase designated discounted products (including e-voucher products, physical products, and/or insurance products, referred to as "Designated Discounted Products") at specified discounted prices (the "Member Discount Price") through this Service on the MyLink platform. (ii) The Customer acknowledges and agrees that the Member Discount Price available under this Service and the Designated Discounted Products to which the Member Discount Price benefits apply may be changed from time to time, provided that the Member Discount Price will differ from the regular price of the Designated Discounted Products by at least HK$1 (the "Minimum Discount"). (iii) The "Member Discount Price" and "Designated Discounted Products" available to the Customer shall be subject to: (1) the real-time Member Discount Price displayed in the "Member Price" section of the "My Membership" page ("Membership Card Page") accessible via the "Link Jetso VIP" entry in the "Vouchers" section of the MyLink App; and (2) the real-time Member Discount Price displayed on the MyLink product detail page of the specific Designated Discounted Product. (iv) The regular price of the Designated Discounted Products shall be based on the price displayed on the MyLink product detail page of the Designated Discounted Products. . b)Daily Offers: (i) During the Service Term of the Customer's subscription to this Service, the Customer may, on each natural day, click to redeem designated cross-border bus coupons, designated merchant consumption coupons, and/or Mainland China consumption coupons ("Daily Coupons") in the "Daily Deals" section of the Membership Card Page. (ii) There may be a redemption quantity limit for Daily Coupons, and details of the Coupons and their relevant quantity limits shall be subject to the description page of the relevant Coupon. (iii) The use of Daily Coupons is subject to relevant terms and conditions. For details, please visit the individual description page of each Daily Coupon. (iv) Daily Coupons have a validity period for use, and the specific validity period shall be subject to the description page of the relevant Coupon. The Customer must use the Daily Coupons before the expiration of their validity period; otherwise, they will expire and will not be reissued or have their validity period extended. (v) Daily Coupons redeemable by the Customer through this Service must be redeemed within the same day when they are available for redemption; no reissuance or supplementary redemption will be provided for overdue redemptions. Daily Coupons that the Customer can redeem on each natural day cannot be accumulated or carried forward to the next natural day. (vi) The Customer acknowledges and agrees that the types of Daily Coupons available for redemption under this Service and the products/services to which the Daily Coupons apply may be changed from time to time. However, if the Customer successfully redeems all available Daily Coupons during the Service Term, the total face value of all redeemed Daily Coupons during such Service Term will be no less than HK$20. (vii) The Daily Coupons available for the Customer to redeem shall be subject to the real-time display on the Membership Card Page. c)Designated Product Point Rewards: (i) During the Service Term of the Customer's subscription to this Service, if the Customer purchases Designated Rebate Products (as defined below) via e-cash payment, the Customer may obtain the corresponding amount of MyLink Points rebate in accordance with Clause 10(c) of these terms and conditions. (ii) Different Designated Rebate Products may have varying MyLink Points rebate percentages ("Rebate Percentage"), which shall be subject to the information displayed on the detail page of each Designated Rebate Product. (iii) The formula for calculating the MyLink Points rebate that the Customer may obtain for purchasing Designated Rebate Products is as follows:
The actual HKD amount paid by the Customer for a single order of Designated Rebate Products after deducting the used discounts and the portion offset by MyLink Points. × Rebate Percentage × 100 (MyLink Points conversion rate) = Eligible MyLink Points quantity.(In case of a non-integer result, the eligible MyLink Points quantity will be rounded down to the nearest integer.)
d) The Customer may receive a maximum of 1,500 Points in total through the Designated Product Points Rebate Entitlement during each Service Term. Once the Customer has reached the 1,500 Points rebate limit within the Service Term, no Points rebate will be awarded for any amount paid for purchasing Designated Rebate Products thereafter. e) The Customer acknowledges and agrees that the Designated Rebate Products and their relevant Rebate Percentages under this Service may be changed from time to time, provided that during the Service Term, at least 2 Designated Rebate Products with a Rebate Percentage of not less than 1% will be offered. f) The Designated Rebate Products and Rebate Percentages shall be subject to the real-time display under the "Cash Payment Points Rebate" section of the Membership Card Page. g) All Points have a validity period, which depends on the time when the Points are credited to the Customer’s MyLink account. The Customer shall use the Points to redeem rewards or purchase designated products/services before the expiration of their validity period; otherwise, the Points will expire and will not be reissued or have their validity period extended. Redemption of MyLink Points is subject to and requires acceptance of the terms and conditions of the MyLink Points Program (details available at https://www.hk.chinamobile.com/tc/mylinkpoints.html). 11. For the one-time membership card, unless the Customer applies for the one-time membership card again, China Mobile Hong Kong will automatically terminate the provision of this Service and the entitlements included in this Service upon the expiration of the Service Term. 12. For Contractual Services, upon the expiry of the Customer’s Contractual Service contract, unless the Customer notifies China Mobile Hong Kong to terminate the Contractual Services, China Mobile Hong Kong will automatically provide this Service on a monthly basis and charge the then-current latest price/standard monthly fee for this Service on a monthly basis. 13. For the Link Jetso VIP (monthly renew), unless the Customer notifies China Mobile Hong Kong to terminate this Service, China Mobile Hong Kong will continue to provide the Link Jetso VIP (monthly renew) on a monthly basis and automatically charge the Customer the then-current standard monthly service fee. The descriptions and terms of the e-voucher products, physical products, and insurance products applicable to this Service shall be subject to the specific terms and conditions of each respective e-voucher product, physical product, or insurance product. China Mobile Hong Kong reserves the right to modify the special descriptions of such products at any time without prior notice. Customers who have successfully subscribed to this Service and wish to terminate it may do so via the following methods: a) For Value-Added Services, the Customer must self-terminate the service through MyLink - "My Value-Added Services". The Customer may also notify China Mobile Hong Kong in person at a store or by calling the customer service hotline at 12580. Otherwise, China Mobile Hong Kong will continue to provide the Service and charge the relevant fees. For the Link Jetso VIP (Single month), the service will automatically terminate upon the end of the Service Term. 14.China Mobile Hong Kong shall not make any representations, warranties, or assume any liability in respect of any relevant information, content, or functions of the products/services to which the three entitlements of Member Price for Products, Daily Deals, and Designated Product Points Rebate apply ("Entitlement Products"), including but not limited to any merchantability, fitness for a particular purpose, availability, quality, nature, accuracy, practicality, or the lawfulness of any intellectual property rights that may be included therein. 15.The information, text, photographs, schematics, and images provided by China Mobile Hong Kong for the description of purchased/redeemed Entitlement Products are for reference only, and the actual products shall prevail. 16.China Mobile Hong Kong reserves the right to change the content of Entitlement Products, or for third-party suppliers/companies to discontinue product supply, or for third-party suppliers/companies to substitute Entitlement Products with those from any other third-party suppliers/companies, without prior notice. China Mobile Hong Kong shall not be liable for any compensation whatsoever. 17.China Mobile Hong Kong has no control over or guarantee for the quality, safety, and legality of Entitlement Products or services provided by third-party suppliers/companies, the truthfulness and accuracy of published content, or the goodwill and credibility of third-party suppliers/companies. If customers have any inquiries, claims, or complaints regarding the quality or supply of Entitlement Products, they shall directly contact the relevant third-party suppliers/companies. China Mobile Hong Kong shall not assume any liability in this regard. 18.If any customer engages in any act or omission that violates the law, these terms and conditions, or may harm the rights of third parties, the customer agrees and covenants to fully indemnify China Mobile Hong Kong against and hold China Mobile Hong Kong harmless from any disputes and claims arising from or related to such acts or omissions. 19.This Service is for the customer’s personal use only. The customer shall not reproduce, resell, share, record, forward any content obtained from this Service, or create an account under another person’s name. 20.In respect of Value-Added Services, if the customer terminates the China Mobile Hong Kong mobile service monthly plan for which the Value-Added Services were applied, this Service will be canceled. For the one-time membership card, if the customer terminates the MyLink account used to apply for the one-time membership card, this Service will be canceled, and no reissuance or compensation will be provided even if the customer later re-registers for a MyLink account with the same phone number. 21.China Mobile Hong Kong may, at any time and with or without notice, (i) cancel or suspend this Service or any part thereof; (ii) restrict or suspend the customer’s use of this Service if China Mobile Hong Kong deems such actions appropriate based on the customer’s use of the Service; (iii) take or refrain from taking any actions that China Mobile Hong Kong deems necessary for the management or operation of the Service or its business for various reasons, resulting in the expansion, reduction, modification, suspension, restriction, or impairment of use of this Service or any part thereof. 22.China Mobile Hong Kong has no control over or guarantee for the quality, safety, and legality of goods or services provided by any third-party supplier ("Supplier"), or the goodwill and credibility of the Supplier. If customers have any inquiries, claims, or complaints regarding the quality or supply of goods or services, they shall directly contact the relevant Supplier. China Mobile Hong Kong shall not assume any liability in this regard. 23.After obtaining Daily Coupons, Member Discount Prices, and/or Points, customers shall not be able to return, exchange, or convert them into cash, nor change, sell, split, donate, or transfer them to others. Disclaimer 24.If China Mobile Hong Kong suspects that any customer is (i) engaging in or associated with abnormal/suspicious activities; or (ii) using improper methods or fraudulent actions that disrupt or interfere with the operation of any part of the service, or cause technical issues; or discovers (iii) any dishonest behavior, or the provision of false, incorrect, or misleading information; or (iv) any violation of these terms and conditions or any applicable laws or regulations; or (v) any malicious or bad faith use of any related services; China Mobile Hong Kong reserves the discretion and final authority to suspend or cancel the customer's eligibility to receive the service or to obtain/use trial offers and future promotional activities without any notice and without any liability to any party, and retains the right to take further action against that customer. 25.If a customer's submitted personal information is incorrect, inaccurate, or misleading due to any factors beyond China Mobile Hong Kong's control, or if this results in China Mobile Hong Kong's inability to contact or verify the customer's identity, it will be considered a waiver of participation in the activity and/or eligibility for benefits products. The customer shall not request a reshipment or any form of compensation, and China Mobile Hong Kong shall not be liable for any such is 26.8.sues. 27.China Mobile Hong Kong shall not be liable for any loss or damage (whether direct or indirect) arising from service failures, interruptions, delays, or temporary suspensions due to power or network failures, or any other circumstances beyond its control. This includes, but is not limited to, issues caused by technical failures, difficulties or errors, network outages, interruptions or congestion, mobile application failures, issues caused by third-party suppliers or companies, software incompatibility, or any other reasons (including but not limited to issues with any terminal devices or internet networks), which may result in delays, losses, errors, unrecognized responses, or failure to obtain benefits products. No reshipment or compensation will be provided by China Mobile Hong Kong for such situations. 28.China Mobile Hong Kong makes no representations or warranties regarding any related data, content, and functionalities of the benefits products, including but not limited to their commercial marketability, suitability for a particular purpose, availability, quality, nature, accuracy, and practicality, or the legitimacy of any intellectual property contained therein. China Mobile Hong Kong shall not assume any liability in this regard. 29.The data, text, photos, illustrations, and images provided regarding the description of the purchased/redeemed benefits products by China Mobile Hong Kong are for reference only. Please refer to the actual products for accuracy. 30.If there are any changes to the content of the benefits products, or if a third-party supplier/company ceases to supply a product, or if a third-party supplier/company substitutes the benefits products with those from another third-party supplier/company, no prior notice will be given. China Mobile Hong Kong shall not be liable for any compensation in such cases. 31.China Mobile Hong Kong has no control or guarantee over the quality, safety, and legality of the benefits products or services provided by third-party suppliers/companies, nor the truthfulness and accuracy of the published content, or the reputation and credibility of the third-party suppliers/companies. If customers have any inquiries, claims, or complaints regarding the quality or supply of the benefits products, they should direct them to the relevant third-party suppliers/companies. China Mobile Hong Kong shall not be held responsible for any such matters. 32.If any customer engages in any actions or omissions that violate the law, these terms and conditions, or may harm the rights of third parties, the customer agrees and promises to fully indemnify China Mobile Hong Kong for any disputes and claims arising from or related to such actions or omissions, and to hold China Mobile Hong Kong harmless. 33.China Mobile Hong Kong shall not be held responsible for any loss or damage resulting from causes that are beyond its reasonable control or not due to its fault or negligence. This includes, but is not limited to, power failures, wars, threats of war, riots or other civil disobedience, violence, natural disasters, restrictions imposed by government or other legal authorities, or any other industrial or commercial disputes, such as fires, explosions, storms, floods, lightning, earthquakes, and other natural disasters, which may cause delays or failures in the performance of any or all terms of these terms and conditions. Customers agree to irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region for any disputes, controversies, claims, or requests arising from these terms and conditions. 40.Each provision of these terms and conditions shall have independent enforceability, and the validity of any provision shall not be affected by the invalidity of any other provision. 41.No person other than the customer and China Mobile Hong Kong shall have any rights under the Contracts (Rights of Third Parties) Ordinance (Cap. 623 of the Laws of Hong Kong) to enforce or enjoy the benefits of any provision of these terms and conditions. 42.China Mobile Hong Kong reserves the right to change the content of this service, terminate the service, and/or amend these terms and conditions at any time without prior notice. Any temporary changes or cancellations related to the service will be evidenced by announcements made by China Mobile Hong Kong. 43.This service does not have an appeal mechanism. In the event of any dispute, China Mobile Hong Kong reserves the right to make the final decision. Any disputes will be evidenced by the records of China Mobile Hong Kong's systems. 44.In the event of any discrepancies between the Chinese and English versions of these terms and conditions, the Chinese version shall prevail.

d) 客户每个服务期限最多可透过指定产品返积分权益领取合共 1500 积分的回赠。客户于服务期限内所获得的积分回赠达到 1500 积分的上限后,任何购买指定回赠产品所支付的金额均不会获得任何积分回赠。 e) 客户知悉并同意本服务下指定回赠产品及相关的回赠百分比将不时更动,但服务期限内最少会提供 2 个回赠百分比不少于 1% 的指定回赠产品。 f) 指定回赠产品及回赠百分比以会员卡页面的「现金支付积分回赠」实时显示为准。 g) 所有积分均有使用有效期。积分有效期取决于积分被存入客户的 MyLink 账户之时间。 h) 客户应于积分有效期满前使用积分作兑换奖赏或购买指定产品 / 服务,逾期作废,并将不获补发或延长有效期,兑换 MyLink 积分须参阅并同意 MyLink 积分计划的条款及细则(详情载于https://www.hk.chinamobile.com/tc/mylinkpoints.html )。 11.就单次会员卡而言,除非客户再次申请单次会员卡,否则服务期限到期后中国移动香港将自动终止向客户提供本服务及本服务所包含之权益内容。 12.就合约服务而言,当客户的合约服务之合约届满后,除非客户通知中国移动香港终止合约服务,中国移动香港将自动按月提供本服务并按月收取当时本服务的最新价格 / 标准月费。 13.就「Link 著数会员卡」(按月服务)而言,除非客户通知中国移动香港终止本服务,否则中国移动香港将继续按月提供「Link 著数会员卡」(按月服务)并按当时最新的标准月费按月自动向客户收取服务费用。 14.本服务适用之电子券商品、实体商品、保险产品之说明及条款,请以具体电子券商品、实体商品、保险产品之条款及细则为准;中国移动香港有权随时修改此类产品特别说明而不作另行通知。 15.成功办理本服务之客户,如欲终止本服务,可通过以下形式中止: a) 就增值服务而言,客户须经 MyLink -「我的增值服务」自行终止。亦可亲临门市或拨打客户服务热线 12580 通知中国移动香港,否则中国移动香港将继续提供本服务并收取有关费用。 b) 就单次会员卡而言,单次会员卡将在服务期限结束后自动终止服务。 16.中国移动香港并不会对有关商品会员价、日日拎著数、指定产品返积分三项权益适用的产品 / 服务(「权益产品」)之任何相关资料、内容及其功能,包括但不限于任何商业适售性、或特定目的之适用性、可用性、质量、性质、准确性和实用性、或当中可能包含之知识产权之正当性作出任何陈述、保证或承担任何责任。 17.中国移动香港就所购买 / 换领的权益产品的描述所提供的资料、文字、相片、示意图及图片等均仅供参考,请以实物为准。 18.权益产品内容如有任何更改、或第三方供应商 / 公司停止供应产品、或第三方供应商 / 公司以任何其他第三方供应商 / 公司产品作为权益产品之替代,恕不另行通知。中国移动香港概不负上任何赔偿责任。 19.中国移动香港对第三方供应商 / 公司提供的权益产品或服务之品质、安全性及合法性,刊登内容之真实性及准确性,第三方供应商 / 公司的商誉与可信性均无控制力及保证。客户如对权益产品的质素或供应情况有任何查询、申索或投诉,应直接向有关第三方供应商 / 公司提出。中国移动香港对此不承担任何责任。 20.如任何客户有任何违反法律、本条款及细则或可能损害第三方权利的行为或不作为,该客户同意并契诺向中国移动香港为其行为或不作为引致或相关的任何纠纷及索赔作出全面弥偿以及使中国移动香港免受损害。 21.本服务只供客户本人个人使用,绝不能复制、转售、与人分享、记录或转寄任何从本服务取得的内容或以其他人名义建立账户。 22.就增值服务而言,如客户终止申请增值服务的中国移动香港流动服务月费计划,本服务将会被取消。就单次会员卡而言,如客户终止申请单次会员卡的 MyLink 账户,本服务将会被取消,即使其后重新以同样的电话号码注册 MyLink 账户亦不会获任何补发或补偿。 23.中国移动香港可随时在发出或不发出通知的情况下 (i) 取消或暂停本服务或其中任何部份;(ii) 限制或暂停客户使用本服务,如中国移动香港认为基于客户对本服务之使用,此等行动是适当的;(iii) 基于不同原因而使中国移动香港认为是对本服务之管理或运作或中国移动香港的业务是必要的而采取或不采取任何行动以致扩大、减少、修改、暂停、限制本服务或其中任何部份,或使其不能使用或受到不良影响。 24.中国移动香港对任何第三方供应商(「供应商」)所提供的商品或服务之品质、安全性及合法性,供应商的商誉与可信性均无控制力及保证。如对商品或服务的质素或供应情况有任何查询、申索或投诉,客户应直接向有关供应商提出。中国移动香港对此不承担任何责任。 25.客户获取每日优惠券、会员折扣价及 / 或积分后,不可退换或兑换现金,亦不能更换丶出售、分拆、转赠或转让他人。 免责声明 26.客户同意不会使用本服务作出以下行为及 / 或用途: (a)      涉及或容许任何侵犯第三方供应商权利、版权或知识产权之行为或内容; (b)      涉及或容许任何违法、不当、淫秽、猥亵、不道德、诽谤、诈骗或不诚实使用、误导、歧视、煽动仇恨、煽动叛乱、分裂、危害公共秩序或危害国家安全等行为或内容; (c)       涉及或容许骇客活动、攻击、干扰或未经授权登入、使用或查阅其他任何第三方供应商装置、设备、设施、系统、网站、网页、资料或内容; (d)       接收、抄录、发布、分发或分销、传递或传阅、或任何利用非法或未经授权之内容; (e)       接收、抄录、发布、分发或分销、传递或传阅、或任何利用商业内容或作商业或传销用途;及 (f)       涉及或容许任何储存、使用、上下载任何工具或软件以作收集任何地址或 IP 位址、任何个人资料、或任何未经授权之资料。 27.中国移动香港不保证以下事项: (a) 本服务符合客户的要求; (b) 本服务不受干扰、及时提供、安全可靠或免于出错; (c) 由本服务之使用而取得之资料为正确或真实;或 (d) 客户经由本服务取得之任何服务、资讯或其他资料将符合客户的期望。 28.客户明白、确认及同意本服务是由中国移动香港按「原样」和「可用」的基础提供的。中国移动香港不就本服务的提供(包括但不限於服务的任何目的的适用性、质量标准或性能或准确性)作出任何类型(明示或暗示)的陈述或保证。中国移动香港在此明确不保证服务不会中断、没有错误或没有任何污染或破坏性的财产。 29.中国移动香港不会对任何客户通讯或个人化设定之时效、删除、传递错误、未予储存资料或因任何资料之下载而导致客户的流动通讯设备内资料遗失及无法恢复承担任何责任。 30.客户同意中国移动香港不会就客户使用本服务的任何功能或内容及本服务可能或实质所造成或引致的任何后果、费用、支出、损失或损害负上任何责任。 31.在任何情况下,中国移动香港均不对本服务的任何收入损失(无论直接或间接)、利润损失或任何间接损失承担合同、侵权(包括疏忽或违反法定义务)或其他方面的责任。 32.中国移动香港在任何情况下均不对客户就任何间接、附带、后果性、依赖或特殊损害或收入损失、数据丢失、储蓄损失或任何形式的利润损失提出索赔,不论诉讼形式如何,无论是在合同、保证、严格责任或侵权行为,包括但不限於任何类型主动的还是被动的疏忽。 33.在无损上文之一般性及在法律容许的最大程度下,中国移动香港在本服务下承担的全部责任金额,包括与本服务相关的索赔、费用、损害赔偿等,均不得超过任何索赔事件发生前 12 个月内客户所支付的服务费总额。 34.客户利用数据网络下载 MyLink 及 / 或使用本服务时,客户须缴付数据传输费用,或从月费计划 / 组合之数据用量中扣除。如客户在香港境外下载 MyLink 及 / 或使用本服务,或需另行支付有关之漫游数据费用 35.客户不得以任何理由要求回赠或退款,包括但不限於本服务任何功能或内容於任何时间内由於维修或技术问题或於中国移动香港不能控制的情况下而被中断或暂停服务,或客户因不同原因而不能使用本服务或串流其中之内容。 36.中国移动香港可随时在发出或不发出通知的情况下︰ (a) 取消或暂停本服务或其中任何部份,以作出系统维修、更新、测试及 / 或维修; (b)   在中国移动香港认为客户不適當地使用本服务的情况下限制或暂停客户使用本服务;或 (c) 中国移动香港基於不同原因认为本服务在无障碍条件下对本服务管理或运作或中国移动香港的业务产生不利影响。中国移动香港可采取任何行动以致扩大、减少、修改、暂停或限制本服务任何功能或内容。 37.中国移动香港发现客户可疑或不确定、欺诈、欺骗、非法或不正当使用本服务下,中国移动香港可暂时或永久暂停客户使用本服务。 38.凡由于中国移动香港无法合理控制或并非其过失或疏忽所致的原因,包括但不限于电力故障、战争、面临战争威胁、骚乱或其他公民抗命行为、暴动、天灾、由政府或任何其他国家法律机关所实施的限制或任何其他工业或行业纠纷、火灾、爆炸、风暴、水灾、雷电、地震及其他自然灾害,以致延迟或未能履行本条款及细则的全部或部分条款而造成任何损失或损害,中国移动香港均无须负责。 个人资料收集声明 39.客户参与本服务即同意及接受中国移动香港收集、使用和披露其个人资料用于本服务之行政及与本服务一切相关用途,以及其他在一般个人资料收集声明和隐私政策声明中列出的用途。客户已细阅、明白及同意中国移动香港之一般个人资料收集声明及隐私政策声明所载之内容,并同意接受其约束。上述声明分别载于:https://www.hk.chinamobile.com/tc/home/contract - terms - conditions/event - tnc - list#3 - 0及https://www.hk.chinamobile.com/tc/home/contract - terms - conditions/event - tnc - list#1 - 0。 40.上述声明乃遵照《个人资料(私隐)条例》(香港法例第486章)的要求而发出,通知客户收集资料的目的,及客户同意中国移动香港使用这些资料及其权利。客户有权根据《个人资料(私隐)条例》(香港法例第486章)的规定,要求查阅或更正客户之个人资料。如有任何查阅或更正资料的要求,请参阅中国移动香港的隐私政策声明之详情。 41.客户如欲查阅个人资料及更正个人资料须致函:中国移动香港有限公司,地址:香港新界葵涌葵昌路51号九龙贸易中心1座20楼,收信人:资料保护主任;或致电中国移动香港拒收商业电子讯息登记热线62264926或客户服务热线12580。 其他注意事项 42.5. 本条款及细则及一切与本条款及细则相关的事项均应受香港特别行政区法律专属管辖及以其作解释及执行。客户同意,如有任何分歧、争议、请求或索赔等,将不可撤回地及无条件地服从香港特别行政区法院的专属管辖权。 43.本条款及细则中的每一条条款应有独立的执行力,其有效性不受其他条款之无效性影响。 44.除客户和中国移动香港外,任何人均不享有《合约(第三者权利)条例》(香港法例第623章)下的任何权利,以执行或享有本条款及细则任何条文的利益或权利。 45.中国移动香港保留随时更改本服务内容及收费、终止本服务、及/或修订本条款及细则的权利,恕不另行通知。任何有关服务的临时改动或取消,将以中国移动香港的公布为确据。 46.本服务不设上诉机制。如有任何争议,中国移动香港保留最终决定权。任何争议将以中国移动香港之系统记录作为确据。 47.本条款及细则的中、英文版如有任何歧义,概以中文版为准。
